What Happened

The International Emergency Economic Powers Act (IEEPA) was used to impose emergency tariffs on imports from multiple countries beginning February 4, 2025. On February 20, 2026, the U.S. Supreme Court struck down these tariffs in a 6–3 decision, ruling that IEEPA does not authorize tariff actions. All duties collected under these orders are now eligible for refund through the standard CBP protest process.

Who Is Eligible

Any importer of record who paid duties under IEEPA tariff orders between February 4, 2025 and February 24, 2026. This includes importers, customs brokers acting on behalf of importers, and businesses that imported goods subject to IEEPA rates during that period.

The 180-Day Deadline Is Running
